These Terms of Service ("Terms") govern your access to and use of the Mortgage Squad Advisors website at mortgagesquad.ca and all related services provided by Mortgage Squad Advisors (Ontario) Inc. ("Mortgage Squad Advisors," "we," "us," "our"). By accessing or using our website or services, you agree to be bound by these Terms.
1. Eligibility
To engage our mortgage brokerage services, you must be at least the age of majority in your province of residence (18 in most provinces; 19 in British Columbia, New Brunswick, Newfoundland and Labrador, Nova Scotia, Nunavut, and Yukon), have legal capacity to enter into a binding contract, and be legally eligible to obtain a mortgage on Canadian real estate. By using our services, you represent and warrant that you meet these requirements.
2. Services & Regulatory Framework
Mortgage Squad Advisors provides mortgage brokerage services including pre-qualification, application processing, lender shopping, file submission, and ongoing mortgage advice. We are licensed under the Mortgage Brokerages, Lenders and Administrators Act, 2006 (MBLAA) by the Financial Services Regulatory Authority of Ontario (FSRA Brokerage License #13737), and comply with FSRA Rule 2019-001 (Mortgage Brokering Conduct of Business). Nothing in these Terms overrides our regulatory obligations under MBLAA, PCMLTFA (FINTRAC), or any other applicable law — where these Terms conflict with a regulatory requirement, the regulatory requirement prevails.
3. No Guarantee of Approval
Submitting an application does not guarantee approval. Lender approval is subject to underwriting, credit assessment, property valuation, OSFI B-20 stress-test compliance (for federally-regulated lenders), and other criteria established by individual lenders. Rates quoted are subject to change and final lender approval. Any pre-qualification estimate we provide is informational and does not constitute a binding pre-approval.
4. Maya AI Disclaimer
Maya is an AI-powered virtual mortgage assistant. Information provided by Maya is for general guidance only and does not constitute financial, legal, tax, or professional advice. Maya cannot make binding decisions, provide formal pre-approvals, or guarantee any rate or product. Maya's responses are generated by machine-learning systems and may contain inaccuracies. For specific advice or formal applications, consult with a licensed advisor at Mortgage Squad Advisors.
5. Use of Website
You agree to use our website only for lawful purposes. You may not: attempt to gain unauthorized access to any part of our system; introduce malicious code or interfere with website operation; copy, scrape, or reproduce content without permission; misrepresent your identity or use our services to commit fraud; submit false or misleading information in any application or form; or use the Maya AI for any purpose that violates applicable law or these Terms.
6. Intellectual Property
All content on mortgagesquad.ca — including text, graphics, logos, software, lender catalogue summaries, the Maya AI platform, and all editorial articles — is the property of Mortgage Squad Advisors or its licensors and is protected by Canadian and international copyright, trademark, and other intellectual property laws. You may view, print, and download content for personal, non-commercial use. You may not reproduce, distribute, modify, or create derivative works without our written permission.
7. Limitation of Liability
To the maximum extent permitted by law, Mortgage Squad Advisors is not liable for any indirect, incidental, special, punitive, or consequential damages arising from your use of our website or services, including but not limited to lost profits, lost opportunities, or business interruption. Our total aggregate liability to you for any claim arising from or related to our services is limited to the greater of (a) the amount of compensation Mortgage Squad Advisors received in connection with the specific service giving rise to the claim, or (b) one hundred Canadian dollars (CAD $100). This limitation does not apply to liability that cannot be excluded by law, including for gross negligence, fraud, or wilful misconduct.
8. Indemnification
You agree to indemnify, defend, and hold Mortgage Squad Advisors and its directors, officers, employees, and agents harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of our services, your violation of applicable law, or any false or misleading information you provide.
9. Force Majeure
Mortgage Squad Advisors is not liable for any delay or failure to perform under these Terms caused by circumstances beyond our reasonable control, including natural disasters, pandemics, government action, regulatory change, internet outages, cyberattacks, or third-party service-provider failures. Where regulatory deadlines apply, we will use reasonable efforts to communicate any anticipated delay.
10. Third-Party Services
Our services involve transmission of information to third parties including lenders, credit bureaus, property appraisers, lawyers, default insurers (CMHC, Sagen, Canada Guaranty), and identity verification providers. We do not control and are not responsible for the acts, omissions, or policies of these third parties. Where we recommend a specific third-party service, our recommendation is not a guarantee of their performance.
11. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. The parties submit to the exclusive jurisdiction of the courts of Ontario for any disputes arising from these Terms, except that nothing in this clause limits your right to file a complaint with FSRA, FINTRAC, the Office of the Privacy Commissioner of Canada, or any other regulator with statutory authority over our conduct.
12. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
13. Changes to These Terms
We may update these Terms from time to time. The last-updated date at the top of this page reflects the most recent revision. Material changes will be communicated by email to active clients and posted on this page. Continued use of our services after a material change constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must discontinue use of our services.
